GENERAL TERMS AND CONDITIONS
Tribu News provides creation, printing and automatically sending diaries which include your content and the content of your other group members (photo and messages) and is editable (allowing you to erase, move and add content) by users. The services offered by Tribu News includes the creation of the album, printing it and automatically sending print version(s) by mail and the digital version(s) by email.
You accept to the terms and conditions without reservation by one of the following ways: (A) selecting “I agree” to such conditions; (B) completing of the registration process; (C) using the Site in any way; or (D) by logging into the Site “www.mytribunews.com”; and thus entering into a legal and binding agreement with Tribu News.
Before using our services, we recommend that you read these terms and all related documents, including the privacy policy.
Under these conditions all references to “you” and / or “your” and / or “user” refers to the party using the services or the Site, thus entering into an agreement with Tribu News subject to these Terms.
1. Admissibility.
By using Tribu News’ services, you declare and guarantee that: (A) all registration information you submit is truthful and accurate; (B) you will maintain the accuracy of such information; you are fully able and competent to enter into an agreement with Tribu News; (C) you are allowed to enter into these conditions on behalf of yourself and the entity that you represent; and (D) your use of the services does not violate any law or regulation.
Tribu News reserves the right to delete your account if we believe that one of the statements above is not true.
2. Registration.
2.1. Registration is done via the “My Account” tab. This must be completed to be valid.
2.2. You are responsible for all activities that occur on your account.
2.3. You agree to notify us immediately of any unauthorized use of your account or any other breach related to your account or the Site Security.
3. Subscriptions
3.1. As a member, you can order a subscription to the album made available by Tribu News.
3.2. You declare that:
i. You own all rights to control the album;
ii. The albums are subject to private use only;
iii. You may not resell any of the albums.
3.3. Each diary will be designed according to your social networks posts (Facebook and/or Instagram) and your contribution. Tribu News reserves the right at any time, without notice, to provide an album of fewer pages than the expected amount if the content available does not allow the creation of a complete diary.
3.4. For each subscription, the price and delivery charges apply, as presented on the site at the time of the order. Not with standing, you may be responsible for additional expenses that are not billed by Tribu News such as customs and import fees, bank fees, etc.
3.5. Your Tribu subscription will automatically renew upon its expiration and will continue to do so until terminated. You authorize us to charge you for the following subscription fee depending on your method of payment.
3.6. Termination. You may terminate the renewal of your Tribu news subscription at any time and you will continue to have access to the service until the end of the period you have already been invoiced. We provide no refunds or credits for periods of partial use. To unsubscribe, send an email to info@mytribunews.com or click on “do not renew my subscription” under “My Subscriptions” in “Your account”. If you cancel your subscription, your account will be automatically closed at the end of your current billing period. To find out when your account will be closed, click on “Subscriptions” in “Your account”.
4. Content.
4.1. Definitions. “Content” includes the text, files, images, photos, videos, copyright works and other materials.
4.2. Ownership of your content. Tribu News does not claim ownership of your content, you are its sole owner. You declare and guarantee that: (i) you own the rights to all the content of your diary, and (ii) the content of your diary does not violate the privacy, publicity, copyright rights or other rights of any person or entity. You agree, however, that Tribu News reserves the right to set limits on archiving diaries, including, but not limited to the right to remove such content after a certain period.
4.3. License to print your diaries. You grant Tribu News a non-exclusive, worldwide, fully-paid and royalty-free license to reproduce and distribute your content for the sole purpose delivering the diaries to you. You agree that Tribu News reserves the right to retain the content to keep an archive copy.
4.4 Prohibited Content. You agree that you will not provide any prohibited content. “Prohibited Content” includes any content that: (i) is offensive, pornographic, or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; (ii) harasses or advocates harassment or intimidation of another person; (iii) is false or misleading or promotes, endorses or encourages activities or behavior that can be considered abusive, threatening, obscene, defamatory or libelous; (iv) promotes, reproduces, performs or distributes an illegal or unauthorized copy of the work of another person that is protected by copyright or trade secret, such as providing pirated computer programs or links to them, providing information to circumvent protection devices, or providing music or links to pirated music files; (v) is involved in the exploitation of people in a sexual or violent manner, or solicits personal information from anyone under the age of majority; (vi) provides instructional information about illegal activities such as making or purchasing illegal weapons, the violation of a person’s privacy, or providing or creating computer viruses and other harmful codes; (vii) solicits passwords or personal identifying information for commercial or unlawful purposes from other users; (viii) violates any law, including but not limited to the laws and regulations governing the control of exports, unfair competition, anti-discrimination and false advertising; (ix) involves commercial activities that are prejudicial to the interests of Tribu News; or (x) violates these Terms. You agree to compensate Tribu News and its subsidiaries, affiliates, officers, employees, suppliers, service providers and business partners harmed by any claims, losses, liabilities and expenses arising out of or relating to any violation of this section.
5. Agreement Policy.
5.1. Your subscription will be considered as accepted upon receipt of an order confirmation to the email address associated with your account.
5.2.Upon receipt of an order confirmation, your subscription will not be canceled unless the order is covered by a special promotion.
5.3. Tribu News reserves the right to accept or decline your order for any reason.
5.4. Tribu News may require additional verification or information before accepting any order.
6. Conditions of Sale.
6.1. Eligibility; register for a subscription, you must be at least eighteen (18) years old or the age of majority applicable in your country. You can pay your order by using the following payment methods: debit card, credit card or bank transfer.
7. Delivery.
7.1. Each subscription must have at least a delivery address.
7.2. All deliveries and prints are processed as quickly as possible, but the process can take between 3-7 business days.
7.3. Delivery delays. The printing and mailing of the diary will still be made on the first business day of the month following the month of issue. The delivery time includes the time it takes to prepare your order for shipping and the delivery time required by the carrier and may vary depending on the reader’s address. The delivery time may be extended when circumstances arise beyond our control.
7.4. Acceptance of delivery. Upon delivery of the diary, you must verify that it matches your order and is in good condition. In case of a problems, it is your responsibility to inform Tribu News of such a problem by email at info@mytribunews.com with your contact details.
8. User Conduct
8.1. You agree not to access or attempt to access the Site by any means other than the interface provided by Tribu News or bypass access or use restrictions put in place by Tribu News.
8.2. You agree to use the Site and the services in good faith and in accordance with these Terms and not to use, encourage others or allow others to:
i. impersonate any person or entity, or state or misrepresent your affiliation with a person or entity;
ii. use the Site in any manner which could damage, disable, overburden, or impair any server or networks connected to a Tribu News server;
iii. intentionally interfere with or disrupt the Site or violate any laws relating to its access or use, requirements, procedures, policies or regulations of networks connected to the Site, or engage in any activity prohibited by these Terms;
iv. disrupt or interfere with the security of accounts, passwords, servers or networks connected to or accessible through the Site or linked sites;
v. disrupt or inhibit any other user from using and enjoying the Service and the Site or other linked sites or platforms
vi. reproduce, sell, trade, resell or exploit for any commercial purposes, any use of the Site, or access to the Site;
vii. defraud, defame, or otherwise violate the legal rights (such as rights of privacy and publicity);
viii. employ methods or automated tools to retrieve data from any part of the Site without our prior written permission;
ix. decipher, disassemble or otherwise attempt to derive all the underlying source code or ideas or part of the Site;
8.3. In addition, you agree to comply with all laws, regulations and ordinances as a condition of the use of services and / or the Site.
8.4. To enable us to protect the quality of our products and services, you agree for our employees and agents to access your account and records for any reason, at our sole discretion. We also reserve the right but do not assume the responsibility, to monitor or review your conduct while using the services of the Site. Your use of the services of the Site is subject to all local, national and international laws and regulations. Furthermore, you acknowledge that you are responsible for obtaining all access lines, telephone and computer equipment (including modem), or other devices needed to access the Site, and pay all related fees.
8.5. You agree not to use the services for any illegal activity and Tribu News reserves the right to investigate any suspicious activity or in response to any complaint reported. When such activity is investigated Tribu News reserves the right to report suspected illegal activity to any person or appropriate body and provide all relevant information, including personal data.
8.6. In case you find an error in the payment collected or paid as a result of using our services, you must notify us immediately at info@mytribunews.com.
9. Copyright policy.
9.1. Tribu News respects the intellectual property of others and asks its members to do the same. Tribu News ‘ policy is to terminate the membership of any member who violates copyrights upon Tribu News ‘ prompt notification by the copyright owner or legal representative of the copyright owner.
9.2. If you believe that your work has been copied and posted on the Services or used in a manner which constitutes a copyright violation, please provide the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the copyright owner; (ii) a description of the work that you claim has been infringed; (iii) a description of the location of the material you claim is infringing the copyright; (iv) your address, telephone number and email address; (v) a written statement by you in good faith that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you own the copyright or are authorized to act on behalf of the copyright owner.
10. Copyright / Trademark Information. The Site and its contents, including the site’s designs, plans, drawings, illustrations, photographs, images, text, graphics, etc. (the “Information”) is protected by the copyright laws of Belgium, international treaties and copyright laws in other countries. The information is the property of Tribu News or third parties that have given Tribu News the permissions to published the copyright information on the Site. The user shall not modify, copy, publish, distribute, broadcast, present, photocopy, issue a license, create derivative works, or sell a portion of the information contained in the Site without the expressed written consent of Tribu News. The user acknowledges the existing copyrights of the information and agrees not to make commercial use of the information or change or amend the information or any part thereof.
11. Third-party Services.
11.1. You acknowledge and accept that Tribu News may engage third-party partners and vendors to provide the Services.
11.2. By using our Services, you agree to be bound by the user agreements established by third-party partners that Tribu News engages.
11.3. By accepting the terms and conditions, you expressly acknowledge that Tribu News acts as a partner entity and that Tribu News has no responsibility for actions or omissions of a third party service.
12. Compensation. You agree to defend, and to compensate Tribu News, its subsidiaries, affiliates, officers, agents and other partners and employees, for harm from any loss, liability, claim or demand, including reasonable attorneys’ fees, suffered by any third party due to or arising from your use of the services in violation of these Terms.

Confidentiality and respect for privacy are among our major concerns.
We are committed to protecting your privacy and personal data. Privacy is at the core of our activities and our mission. To protect you and your family, all content we receive while you are using Tribu News and your personal information are subject to this privacy policy.
This privacy policy explains our policy on the type of information we may collect from you when you use the Tribu News site, why we collect it and how we use it.

Your contact details also allow us to send you information on the activities of TRIBU NEWS and/or our products. TRIBU NEWS has a legitimate interest in promoting its services to people who have come into contact with it, who have expressed an interest in its activities or with its leads. TRIBU NEWS sends advertisements or newsletters by email only with the prior consent of the data subject (opt-in).
4.2. If you are a customer
We process:

• your personal information on your Facebook and Instagram account (optional);
• your contact details (email, telephone);
• your billing data (postal address, country, telephone, payment method);

• your data relating to your IP address and your login on the TRIBU NEWS Platform;
We use the aforementioned data to:
1. conclude and perform a contract that you have subscribed to or wish to subscribe to in order to use our services;
2. send you targeted advertisements in order to promote our services (soft opt-in);
4.3. If you are a supplier or a commercial service provider,
We process the following data:
• your personal identity data (surname, first name, gender, preferred language);
• your contact details (email, telephone);
• your professional information (company, position);
We process your data to be able to perform a commercial contract concluded with us.
4.4. If you are a visitor to our website
When you visit our website, we collect information about your browser, IP address, etc., mainly to make the use of our site as efficient and user-friendly as possible and to protect our IT systems from attack and other unlawful activities. 5. How long are your data kept?
We keep your data for as long as necessary for the conclusion of the contract, the performance of the contract or the follow-up of our contractual relationship.
We delete your personal data as soon as the purpose for which we collected and processed them ceases to exist, within the following deadlines:
1. The data processed in the context of the performance of a (future) contract are actively kept for as long as necessary for the performance of the contract or the follow-up of our contractual relationship, and will then be archived for the statutory period of 10 years for contractual actions, and then finally deleted at the end of the statutory period.
2. Data on leads processed as part of pre-contractual measures which do not lead to the conclusion of a contract are kept and will be deleted after 2 years if the lead has taken no commercial action within that period.
3. Information collected during your visit to our website will be deleted in accordance with the cookie policy.
6. Who can your data be transferred to?
Your personal data may be transferred to our suppliers, subcontractors and professional service providers, who provide services including data processing on our behalf. These parties may process your personal data solely to perform their task and within the limits of our instructions.
Where our suppliers and subcontractors are located in countries outside the European Economic Area, TRIBU NEWS ensures that appropriate precautions and security measures are put in place to guarantee the security and confidentiality of your personal data. TRIBU NEWS will take particular care to observe the following safeguards:

Apart from these cases, TRIBU NEWS does not communicate any of your personal data, whether pseudonymised or not, to third parties.

Right of access: where permitted by law, you have the right to ask whether we are processing your personal data and what personal data about you are being processed. As a customer, the member area of the TRIBU NEWS Platform gives you access to most of the personal data that is processed by our services.
In any event, if you make a specific request, access will be granted only if, on the basis of the information in its possession, TRIBU NEWS can identify you with certainty. Any request for access to your data must be accompanied by a copy of your identity card.
TRIBU NEWS has 30 days to respond to your request; this period begins to run only when we have received all the information required to comply with your request.
Right of rectification: you can ask us to rectify and/or complete any of you personal data that is inaccurate or incomplete.
As a customer, the member area of the TRIBU NEWS Platform already allows you to correct and/or complete some of your personal data. Via “your account” you can: (1) confirm the accuracy of the personal information we have collected about you; (2) update your personal information.
Right to erasure: without prejudice to the statutory retention periods laid down in Article 5, you can ask us to erase your personal data, in particular when they are no longer needed for the purposes for which they were collected or processed, or if you have withdrawn your consent to their processing and there are no other lawful grounds for processing them.
Right to restriction of processing: subject to certain conditions, you have the right to request restriction of processing, in which case your personal data may not be processed, except for their storage, by TRIBU NEWS without your consent or for the establishment, exercise or defence of legal claims, for the protection of the rights of third parties or for reasons of important public interest.
Right to data portability: if technically possible, you have the right to ask us to transmit your personal data to another controller.
Right to object: you always have the right to object, without no need to state grounds and at no charge, to the use of your personal data for direct marketing purposes. Right of access
When allowed by law, you can obtain confirmation that data about you are being processed by us, and if so, have access to them. Any access request will be granted only if, on the basis of the information in our possession, we can identify you securely.

Right to object
You always have the right to object, without no need to state grounds and at no charge, to the use of your personal data for direct marketing purposes.
Remedy in the event of a complaint
If you believe that your rights relating to the processing to which you are subject have not been respected, you can lodge a complaint at the following email address: info@mytribunews.com or, if no satisfactory follow-up is forthcoming, to the relevant Supervisory Authority (e.g. "Data Protection Authority").
